The Site Administration offers you the services of the Site on the terms and conditions that are the subject of these Rules for using the VKontakte . Status of the Rules for Use of the VKontakte Site
§ 1.1. Administration of the VKontakte Site
§ 3.1. In these Rules and other special documents posted on the Site, the Administration of the VKontakte Site (previously and hereafter referred to as the Site Administration, Administration) means the Limited Liability Company "VKontakte", a legal entity created under the laws of the Russian Federation and registered at the address: 191015 , St. Petersburg, st. Tverskaya, 8, lit. B.
§ 3.2. Appeals, suggestions and claims of individuals and legal entities to the Site Administration in connection with these Rules and all issues regarding the functioning of the Site, violations of the rights and interests of third parties when using it, as well as for requests from persons authorized by the legislation of the Russian Federation can be sent to the postal address of LLC “In Contact”, specified in clause 3.1. of these Rules.
§ 3.3. Registration on the VKontakte Site and User status
§ 4.1. User registration on the Site is free, voluntary and can be done at the Internet address: https://vk.com .
§ 4.2. A user of the Site is an individual registered on the Site in accordance with the procedure established by these Rules, who has reached the age permitted in accordance with the legislation of the Russian Federation for accepting these Rules, and who has the appropriate powers (hereinafter referred to as the User).
§ 4.3. When registering on the Site, the User is obliged to provide the Site Administration with the necessary reliable and up-to-date information to create the User’s personal page, including a unique login for each User (email address or a combination of Latin letters and numbers to enter the Site) and password for access to the Site, as well as last name and first name. The Site's registration form may request additional information from the User.
§ 4.4. The user is responsible for the accuracy, relevance, completeness and compliance with the legislation of the Russian Federation of the information provided during registration and its purity from claims of third parties.
§ 4.5. After providing the information specified in clause 4.3. of these Rules, the User must undergo a number of identification procedures, namely, (a) confirm registration by recognizing an automated test designed to distinguish between computers and people (“captcha”); (b) confirm your registration by activating your personal page through a message sent by the Site Administration to the User’s email; (c) confirm registration by entering into the appropriate form on the Site the code received by the User in the form of an SMS message from the Site Administration to the User’s mobile phone, the number of which is provided by the User himself. If all registration actions are correctly and sequentially completed on the Site, a personal User page is created with a network address of the form https://vk.com/id[number] . The user has the right to assign a short (subdomain) name to his personal page, replacing the serial number id when addressing on the Internet. Words and names cannot be selected as a subdomain name, the use of which is prohibited in accordance with these Rules, the current legislation of the Russian Federation and international legal acts, including, but not limited to, obscene language, names registered as trademarks (regardless of from the ICGS class), brand names and commercial designations, if the user does not own exclusive rights to them. If a violation of these conditions is detected, the Administration has the right to prohibit the User from using the subdomain name assigned to him, including, if applicable, transferring the right to use it to the appropriate person (representative of the copyright holder). The user has the right to register no more than one personal page on the Site.
§ 4.6. Upon registration, the User agrees to these Rules and assumes the rights and obligations specified therein related to the use and operation of the Site. The User acquires full rights to use the Site Services provided that the personal page is filled to more than thirty percent.
§ 4.7. After successful registration of the User on the Site, the Administration assumes the rights and obligations to the User specified in these Rules.
§ 4.8. The processing of the User's personal data is carried out in accordance with the legislation of the Russian Federation. The Site Administration processes the User’s personal data in order to provide the User with services, including for the purpose of receiving personalized (targeted) advertising by the User; verification, research and analysis of such data, allowing to maintain and improve services and sections of the Site, as well as develop new services and sections of the Site. The Site Administration takes all necessary measures to protect the User’s personal data from unauthorized access, modification, disclosure or destruction. The Administration provides access to the User’s personal data only to those employees, contractors and agents of the Administration who need this information to ensure the functioning of the Site and provide Services to the User. The Site Administration has the right to use the information provided by the User, including personal data, in order to ensure compliance with the requirements of the current legislation of the Russian Federation (including for the purpose of preventing and/or suppressing illegal and/or illegal actions of Users). Disclosure of information provided by the User can be made only in accordance with the current legislation of the Russian Federation at the request of the court, law enforcement agencies, as well as in other cases provided for by the legislation of the Russian Federation. Since the Site Administration processes the User’s personal data in order to fulfill the concluded agreement between the Site Administration and the User for the provision of Services, due to the provisions of the legislation on personal data, the User’s consent to the processing of his personal data is not required.
§ 4.9. The login and password chosen by the User are necessary and sufficient information for the User to access the Site. The user does not have the right to transfer his login and password to third parties, and bears full responsibility for their safety, independently choosing the method of storing them. The user, on the hardware and software he uses, can allow the storage of a login and password (using cookies) for subsequent automatic authorization on the Site.
§ 4.10. Unless proven otherwise by the User, any actions performed using his login and password are considered to have been performed by the corresponding User. In the event of unauthorized access to the login and password and/or personal page of the User, or distribution of the login and password, the User is obliged to immediately notify the Site Administration about this in the prescribed manner.
§ 4.11. After registration, the User receives the right to independently create, use and determine the content of his own personal page and the conditions for access of other Users to its content for personal non-commercial purposes, and also receives the ability to access and post information on the personal pages of other Users (subject to obtaining appropriate access rights from their owners), use of VKontakte social widgets on third-party sites without additional authorization. When the User uses social widgets, third-party sites are not provided with information about the User’s login and password, as well as his data protected by privacy settings.
§ 4.12. The User, as the owner of the information posted on his own personal page, understands that, except for cases established by these Rules and the current legislation of the Russian Federation, the Site Administration does not participate in the formation and use of content and control of access of other users to the User’s personal page.
§ 4.13. Creating and using Communities
§ 4.13.1. The User has the right to create Communities (groups, official pages and meetings) for the purpose of promoting commercial, political, charitable and other non-profit organizations, brands, goods, works and services, as well as various events (hereinafter referred to as Promotion Objects). Objects of promotion, methods and methods of their promotion must comply with the current legislation of the Russian Federation, including legislation on advertising, international legal acts, these Rules, as well as recognized ethical standards and principles of morality, including those related to those in the opinion of the Site Administration. Objects provided for in paragraphs cannot act as Promotion Objects. 3.1. – 3.5., paragraph 3.8., paragraphs. 3.10. – 3.14. Rules for placing advertisements.
§ 4.13.2. When creating and administering the Community, including when registering a subdomain name used to address the Community page, the User confirms that he is acting legally (for example, by proxy), has all the necessary rights and does not violate by his actions the legal rights and interests of third parties persons and the current legislation of the Russian Federation, including legislation on competition and rights to the results of intellectual activity and means of individualization.
§ 4.13.3. In the Community, including in the description, on the main photo of the Community, in albums, in news, discussions, polls, audio recordings, video recordings, on the wall, it is not allowed to post the Content (in the meaning provided for in clause 6.1.1 of these Rules) in its entirety or in parts without the prior permission of the copyright holder, as well as the information provided for in clause 5.3.4. of these Rules. The user administering the Community is obliged to independently monitor and suppress the posting of information in the Community that does not comply with the Rules, and, if necessary, block users who violate these Rules from accessing the Community using the functionality of the Site.
§ 4.13.4. In the Community, including in the description, on the main photo of the Community, in albums, in materials, discussions, surveys, pinned posts on the wall, etc., the placement of third-party commercial and political advertising is not allowed. No more than 3 (three) third-party advertisements per day can be posted on the Community wall (with the exception of pinned posts in which advertising is not allowed). No more than 3 (three) third-party advertisements per week can be posted on the wall of a Community included in the list of Popular Communities. Third-party advertising is any information that is not directly related to the Community and the Promotion Object, distributed in any form both on behalf of the Community and on behalf of other communities and users, and aimed at attracting the attention of users to the object of advertising, generating or maintaining interest in it . The user administering the Community must independently monitor and suppress the placement of third-party advertising in the Community that does not comply with the Rules. The community can be placed in the search system of the VKontakte Site subject to mandatory compliance with the requirements provided for in this paragraph.
§ 4.13.5. All third-party advertisements must comply with paragraphs. 1 and 3 of the VKontakte Advertising Rules.
§ 4.13.6. The Site Administration has the right, at its own discretion, to create and post a list of recommended Communities, based on their information value for users and other criteria. For Communities on the recommended list, additional restrictions apply - no more than 3 (three) third-party advertisements per week. In case of non-compliance with this restriction, the Site Administration has the right to exclude the Community from the list of recommended ones.
§ 4.13.7. The User bears full responsibility for his actions related to the creation and administration of Communities in accordance with the current legislation of the Russian Federation, international legal acts and these Rules.
§ 4.13.8. If a violation of the legal rights and interests of third parties, the current legislation of the Russian Federation, as well as the provisions of these Rules is detected in the Community, the Site Administration has the right, at its own discretion, to take the following measures: a) remove Content and other information from the Community page and/or block access to them; b) block access of specific users to the Community page; c) block access of the User administering the Community to the Community; d) transfer the rights to administer the Community, as well as the right to use a registered subdomain name, to the legal copyright holder, who has duly confirmed his rights to the Community Content, including the right to objects of copyright, related rights, as well as the right to a means of individualization similar to the extent confusion with a subdomain name used in the Community; e) exclude the Community from the search system and/or block the Community; f) temporarily prohibit the publication of any links in the Community.
§ 4.13.9. If the Community violates the procedure for placing third-party advertising (provided for in clause 4.13.4 of these Rules), the Site Administration has the right to limit the advertising activities of the Community by prohibiting the publication of any links in the Community for a period of one week or more at the discretion of the Administration. In case of attempts to circumvent the technical restriction on the publication of links (inserting additional characters, publishing images with links, etc.) during the period of the ban, the Administration has the right to block the Community without the possibility of recovery.
§ 4.14. With regard to information about himself, the User has the right: (a) to independently delete information previously posted by the User on the Site; (b) independently delete the User’s personal page using the “delete your page” functionality available to the User in the “My Settings” section.
